In the eyes of the court, a party is eligible if he or she meets the following

- The paying spouse must have received deferred adjudication or have been
convicted of a domestic violence crime that occurred during the marriage
or while the divorce was pending, OR, the spouse seeking maintenance must
be unable to earn an income that allows him / her to pay for reasonable needs.
The length and amount of alimony will depend on a number of factors, such as:

- Occupational history
- Any infidelity
- Contributions to the family as a homemaker
- Attempts to find work
- The age of the spouse seeking maintenance
